These Terms & Conditions govern use of the Rob Kirman Photography website and provide general information about the services offered.

Individual photography commissions, events, workshops and commercial projects may also be governed by a separate quotation, booking agreement or contract. Where a separate agreement applies, its service-specific terms will take precedence in relation to that booking.

1. About Rob Kirman Photography

Rob Kirman Photography provides photography, photographic artwork, commercial imagery, teaching and related services.

2. Website Use

The information on this website is provided in good faith and is intended to give a general description of the services available.

You may browse and use the website for personal and legitimate business-enquiry purposes.

You must not copy, reproduce, modify, distribute or commercially exploit website content without permission except where permitted by law.

3. Enquiries and Bookings

Submitting an enquiry does not itself create a booking or contract.

A booking becomes binding when the agreed booking process has been completed. This may include:

• Acceptance of a quotation or booking agreement
• Acceptance of any relevant terms
• Payment of any agreed booking fee

The exact services, price, timings, deliverables and other booking-specific details will be confirmed separately.

4. Prices and Payment

Prices displayed on this website are subject to change unless they have already been confirmed as part of an accepted booking.

Any booking fee, instalment arrangements, payment dates or cancellation conditions will be explained before the client becomes contractually committed.

Nothing in these terms affects your statutory consumer rights.

5. Consumer Cancellation Rights

Where a consumer enters into a qualifying distance or off-premises service contract, they will normally have a 14-day cancellation period beginning the day after the contract is made. 

If the client expressly asks for services to begin during that cancellation period, they may be required to pay for work reasonably carried out before cancellation.

If the service is fully performed during the cancellation period following the client's express request and acknowledgement, the statutory right to cancel may be lost.

Any additional cancellation or rescheduling arrangements will be explained in the relevant booking agreement.

6. Client Cancellation or Rescheduling

If a client needs to cancel or rearrange a booking after any applicable statutory cancellation period, the terms set out in the relevant booking agreement will apply.

Where possible, I will aim to deal with genuine changes of circumstance reasonably and fairly.

7. Cancellation by Rob Kirman Photography

If I am unable to fulfil a booking because of illness, emergency or circumstances genuinely beyond my reasonable control, I will inform the client as soon as reasonably possible and seek an appropriate solution.

This may include:

• Rescheduling the booking
• Arranging an appropriate replacement where suitable and agreed
• Refunding sums paid for services that cannot be provided

8. Photography Style and Creative Judgement

By booking Rob Kirman Photography, clients acknowledge the photographic style and approach shown through my portfolio.

I retain reasonable artistic and professional discretion over matters including:

• Composition
• Lighting
• Image selection
• Editing
• Colour treatment
• Cropping
• Final presentation

While reasonable requests will always be considered, no guarantee can be made that every particular moment, individual or requested photograph will be captured.

9. Image Selection and RAW Files

Final photographs are selected and edited as part of the creative service.

Unedited RAW files, rejected images, test frames and duplicate photographs are not normally supplied unless specifically agreed in writing beforehand.

10. Delivery

Estimated delivery times will be provided as part of the relevant booking information.

Where online galleries or digital delivery are used, clients are responsible for downloading and safely backing up their final photographs within any stated availability period.

Rob Kirman Photography should not be regarded as a permanent storage or archive service for client photographs.

11. Copyright and Permitted Use

Unless otherwise agreed in writing, copyright in photographs created by Rob Kirman Photography remains with the photographer.

Private clients will normally receive permission to use their delivered photographs for personal purposes.

Commercial clients will receive the usage rights or licence agreed for the relevant commission.

Images may not be commercially exploited, sold, licensed to third parties or substantially altered beyond the agreed use without permission.

12. Portfolio and Promotional Use

Use of identifiable commissioned photographs on my website, portfolio, social media, exhibitions, competitions, publications or promotional materials will be handled in accordance with the relevant booking agreement and applicable data-protection requirements.

Where separate permission or consent is required, this will be requested appropriately.

13. Prints, Albums and Physical Products

Colours and appearance may vary slightly between screens and printed products because of differences in monitors, papers, inks and production processes.

Any fault or damage should be reported promptly after receipt so that the issue can be investigated.

Nothing in these terms limits statutory rights relating to faulty goods.

14. Incredible Irises

Iris photography offered by Rob Kirman Photography is a creative photographic and artistic service.

It is not a medical examination, screening service, diagnosis or assessment of eye health.

Anyone with concerns about their eyesight or eye health should seek advice from an appropriately qualified healthcare professional.

15. Commercial Photography

The permitted use of commercial photographs will be defined by the relevant quotation, licence or contract.

Unless otherwise agreed in writing, a commercial commission does not automatically transfer copyright ownership to the client.

16. Teaching and Workshops

Participants are responsible for ensuring that their equipment is suitable for the activity and for following reasonable safety instructions.

Workshop content, teaching notes and learning materials remain protected by copyright and may not be reproduced or commercially redistributed without permission.

17. Conduct and Safety

I reserve the right to pause or stop work where continuing would create an unreasonable risk to the safety or welfare of:

• The client
• The photographer
• Participants
• Members of the public
• Animals
• Property

18. Website Content

All original photographs, written material, branding and other original content on this website are owned by or licensed to Rob Kirman Photography unless stated otherwise.

Unauthorised reproduction or commercial use is prohibited.

19. External Links

This website may contain links to third-party websites or services.

Rob Kirman Photography is not responsible for the content, availability or privacy practices of independent third-party websites.

20. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful.

Subject to your statutory rights, Rob Kirman Photography will not be responsible for losses that were not reasonably foreseeable or that arise from circumstances genuinely outside reasonable control.
